The service
These terms cover an Onyx Node ordered on looponyx.com or looponyx.ch. Shared hosting, domain names, and other servers are quoted by email and are a separate arrangement. The brochure at ultreme.co.uk does not by itself create a hosting contract.
You choose a size, a city, an image, and a hostname. We build the server after Stripe confirms the payment. Auction hardware is best effort. We do not promise a named CPU, and we do not publish an uptime percentage.
Price and tax
The price on the order is the price you pay for that month. Prices shown before checkout are placeholders until Ultreme replaces them. The amount is set by the catalog on our server. The browser cannot set it.
Automatic tax is off until Ultreme has an active VAT registration. A renewal is a new payment for 30 days. It is not a stored-card subscription.
Cancellation
If you are a consumer, you may cancel within 14 days of the order while the server has not been built. If you ask us to build it during those 14 days, you acknowledge that the cooling-off right ends once the service has started, and you may pay for the time already supplied. This follows the Consumer Contracts Regulations 2013.
After the server is built, that month is not refunded except where the law requires a refund.
Your use of the server
You are responsible for what runs on the server, for the accounts you create on it, and for any backup. We do not keep a backup unless a written agreement says so.
You must have a lawful basis for personal data you store there. You must not use the server to attack other systems, to send spam, or to host sexual images of children. The abuse page says what we do next.
Liability
Nothing in these terms excludes liability for death or personal injury caused by negligence, or for fraud.
Other liability for a server is limited to the fees you paid for that server in the three months before the claim. The governing law is England and Wales. The courts of England and Wales decide disputes.
